With the passage of several public records reform legislation in 2018, law enforcement agencies must change the way they respond to requests for incident and personnel records. The new California Public Records Act expansion is creating a deep, dark hole in the Pitchess protections: with a complex array of new disclosure requirements and limited restrictions that can be baffling to even the most experienced hands. Do you have the tools to understand these NEW LAWS and the guidance to navigate the impact on you, your department, and law enforcement in California moving forward?
CPOA is proud to present a seminar entitled: “Records Release Mandates: Law Enforcement’s New Normal” in which multiple viewpoints with potential solutions and responses to your concerns regarding the bills which gave us these new laws (AB748, SB1421, and SB978). There will also be a focus on AB392, Assembly Member Shirley Weber’s 2019 use of force legislation that raises the application standard to “necessary” and poses as one of the most significant threats to public safety in our lifetime.
Our speakers for this seminar are from three different law firms around California and very connected to these bills in either direct lobbying/negotiations/discussions. They will be sharing their viewpoints on the legislative history, new statutes, and practical implications and burdens police departments can expect. The seminar will also include a discussion of best practices for handling video releases, including whether to provide edited and/or narrated versions as well as raw video and redaction requirements.

Jim Touchstone, Jones & Mayer
James Touchstone is a partner in Jones & Mayer. Mr. Touchstone is the Litigation Department Manager for the firm. He is also the Law Enforcement Advisory Department Manager. His primary practice areas include litigation of civil rights actions, police representation, tort defense, and employment/discrimination claims. Mr. Touchstone’s representation has included the defense of a number of civil rights lawsuits alleging a variety of claims ranging from excessive force claims arising from officer-involved-shootings to false arrest claims and First Amendment claims. He has significant trial experience in both state and federal court. In addition, he assists law enforcement agencies in drafting of policies and procedures to ensure compliance by these agencies with the most recent state and federal case law. Mr. Touchstone has also defended literally hundreds of Pitchess motions in both the trial and appellate courts. He also provides general legal advice to a number of police agencies throughout the State on a variety of day-to-day issues that arise during the course of performing law enforcement duties. Mr. Touchstone also serves as General Counsel for the California State Sheriffs’ Association (“CSSA”), the California Police Chiefs Association (“CPCA”) and the California Peace Officers’ Association (“CPOA”).
David Mastagni, Mastagni Holstedt, A.P.C.
David E. Mastagni is a partner with the law firm of Mastagni Holstedt, APC, who specializes in labor and employment law representation of public safety employees, including trial and appellate litigation in California and federal courts. In particular, he handles complex civil, class action and collective action litigation, claims arising out of the Fair Labor Standards Act, the U.S. and California Constitutions, the California Public Records Act, the Public Safety Officers Procedural Bill of Rights, the California Labor Code, the Myers-Milias-Brown Act, and other statutes protecting the rights of employees. David is an experienced panel attorney for the Peace Officers’ Research Association of California (PORAC) Legal Defense Fund. He frequently gives lectures on the POBR, critical incident investigations, labor relations issues, the FLSA and other employment related issues. Recently, David filed a Supreme Court amicus brief on behalf of several peace officer unions in San Jose v. Superior Court, supporting the disclosure of public records maintained by public officials on personal devices.
Tony Sain, Manning & Kass, Ellrod, Ramirez, Trester, LLP
Tony M. Sain is a partner in the Los Angeles office of the law firm of Manning & Kass, Ellrod, Ramirez, Trester LLP, where he practices on the Governmental Entity Defense Team defending public agencies and officers in civil rights actions and employment cases, as well as other clients in general litigation, including the defense of other public and private entity tort cases and entertainment-related matters. Mr. Sain has successfully defended our clients as a lead trial attorney in several jury and administrative trials on police/civil rights or employment cases, and he has also served as a pro bono prosecutor at trial for Los Angeles District Attorney’s Office. Before starting his second career as a litigation attorney, Tony worked for more than a decade as a senior executive for a variety of mid-size corporations and non-profit organizations, including as an Executive Director of the YMCA. As an executive, he specialized in organizational overhauls for troubled operations, consumer and trade marketing, community relations and organization, and media relations. When not devoting his to time to advocating for his clients, Tony enjoys horseback riding, weightlifting, rock climbing, amusement parks, and playing competitive beach volleyball.
